【Accommodation Policy】

Scope
Article 1

  • 1. Accommodation and associated agreements entered into between the Hotel and guests shall be subject to the provisions of this Policy, and any items not specified in this Policy shall be subject to laws and regulations or generally established practices.
  • 2.  Notwithstanding the provisions of the preceding paragraph, special conditions shall take precedence provided that the Hotel adheres to the special conditions in a way that does not violate laws and regulations or established practices.

Applying for an Accommodation Agreement
Article 2

  • 1. Guests wishing to apply to the Hotel for an accommodation agreement shall provide the following information to the Hotel.
    • (1) Name of guest(s)
    • (2) Date of stay and scheduled arrival time
    • (3)  Accommodation charge
    • (4) Other information required by the Hotel
  • 2. In the event that guests request to extend their stay beyond the period stated in item (2) in the preceding paragraph, the Hotel shall treat this as an application for a new accommodation agreement when the request to extend the stay period is made.

Establishing an Accommodation Agreement, etc.
Article 3

  • 1. The accommodation agreement shall be established when the Hotel consents to the application mentioned in the previous article. However, this shall not apply if it is proved that the Hotel did not consent to the application.
  • 2. According to the provisions of the preceding paragraph, when the accommodation agreement is established, guests shall pay an application fee limited to the basic accommodation charge for the accommodation period, as determined by the Hotel and by the date specified by the Hotel.
  • 3. The application fee shall first be allotted to the accommodation charge to be ultimately paid by the guest, and it shall be allotted to a penalty charge and then compensation if a matter applying to the provisions of Articles 6 or 18 arises. If there is a remaining amount, it shall be refunded when paying the charge stipulated in Article 12.
  • 4. If the application fee mentioned in paragraph 2 above is not paid by the date specified by the Hotel in accordance with the provisions set forth in the same paragraph, the accommodation agreement shall become ineffective. However, this shall only apply if the Hotel notifies the guest when specifying the payment date of the application fee.

Special Conditions when Application Fee Is Not Required
Article 4

  • 1. Irrespective of the provisions set forth in paragraph 2 of the previous article, the Hotel may allow special conditions whereby the application fee does not have to be paid following establishment of the agreement.
  • 2. When consenting to the application for an accommodation agreement, in the event that the Hotel does not seek payment of the application fee or specify the payment date for the application fee as mentioned in paragraph 2 of the previous article, the special condition mentioned in the previous paragraph shall be allowed.

Refusal to Enter Into an Accommodation Agreement
Article 5

  • 1. The Hotel may refuse to enter into an accommodation agreement in event of the following.
    • (1) When the accommodation application does not comply with this Policy;
    • (2) When there are no guest room vacancies;
    • (3) When it is confirmed that the accommodation applicant may commit an act in relation to the accommodation that is contrary to public order or morality, or to the provisions of laws and regulations;
    • (4) When it is confirmed that the accommodation applicant corresponds to any of the following from ① to ③
      • ① An organized crime group specified in Article 2 (item 2) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as an “Organized Crime Group”); an Organized Crime Group member specified in Article 2 (item 6) of the same law (hereinafter referred to as an “Organized Crime Group Member”); an organized crime associate member; or a person involved in an Organized Crime Group or any other antisocial force.
      • ② When an Organized Crime Group or Organized Crime Group Member is a corporation or other organization that manages business activities.
      • ③ A member of the corporation and its officers corresponds to an Organized Crime Group Member.
    • (5) When the accommodation applicant uses speech or behavior that may significantly inconvenience other guests;
    • (6) When it has been clarified that the accommodation applicant is a carrier of an infectious disease;
    • (7) When demands regarding accommodation are made by using violence or place a burden on the Hotel that exceeds the limits of what is deemed reasonable;
    • (8) When accommodation cannot be allowed due to a natural disaster, trouble with the facilities or for any other unavoidable reason;
    • (9) When it is feared that the accommodation applicant is a drunkard, or similar, and may significantly inconvenience other guests, or uses speech or behavior that may significantly inconvenience other guests. (Based on the provisions of prefectural ordinances.)

Guests’ Right to Cancel the Agreement
Article 6

  • 1. Guests may apply to the Hotel to cancel the accommodation agreement.
  • 2. In the event that all or part of the accommodation agreement is canceled due to circumstances attributable to the guest (excluding cases when the Hotel specifies a payment date for the application fee and seeks payment in accordance with the provisions of Article 3, paragraph 2, and the guest cancels the accommodation agreement before payment), the Hotel shall receive a penalty charge. However, in cases when the Hotel complies with the special conditions in accordance with the provisions of Article 4, paragraph 1, the obligation for the guest to pay the penalty charge due to cancellation of the accommodation agreement shall be limited to when the Hotel has notified the guest of such.
  • 3. In the event that the guest does not arrive at the Hotel by 10:00 p.m. on the day of the stay (or two hours after the scheduled arrival time, if such time has been indicated in advance), the Hotel may consider that the accommodation agreement has been canceled by the guest.

Hotel’s Right to Cancel the Agreement
Article 7

  • 1. The Hotel may cancel the accommodation agreement in event of the following.
    • (1) When it is confirmed that the guest has committed or may commit an act contrary to the provisions of laws and regulations or to public order or morality with regard to accommodation;
    • (2) When it is confirmed that the guest corresponds to any of the following from ① to ③
      • ① An Organized Crime Group, an Organized Crime Group Member, an organized crime associate member, a person involved in an Organized Crime Group, or any other antisocial force.
      • ② When an Organized Crime Group or Organized Crime Group Member is a corporation or other organization that manages business activities.
      • ③ A member of the corporation and its officers corresponds to an Organized Crime Group Member
    • (3) When the guest uses speech or behavior that may significantly inconvenience other guests;
    • (4) When it is clarified that the guest is a carrier of an infectious disease;
    • (5) When demands regarding accommodation are made by using violence or place a burden on the Hotel that exceeds the limits of what is deemed reasonable;
    • (6) When accommodation cannot be allowed due to a force majeure such as a natural disaster.
    • (7) When it is feared that the accommodation applicant is a drunkard, or similar, may significantly inconvenience other guests, or uses speech or behavior that may significantly inconvenience other guests (Based on the provisions of prefectural ordinances.); and
    • (8) When the guest smokes in bed, misuses fire-extinguishing equipment, etc., or fails to obey regulations for use regarding other prohibited matters (limited to those necessary for fire prevention) as determined by the Hotel.
  • 2. When the accommodation agreement is canceled by the Hotel based on the provisions of the preceding paragraph, the guest will not be charged for accommodation services, etc. with which the guest has not yet been provided.

Accommodation Registration
Article 8

  • 1. Guests shall register the following information at the Front Desk on the day of their stay.
    • (1) Name, age, gender, address, and occupation of guest(s)
    • (2) In the case of foreign nationals: nationality, passport no., place and date of entry into Japan
    • (3) Date and scheduled time of departure
    • (4) Other information required by the Hotel

Guest Room Use Time
Article 9

  • 1. Guests may stay in the Hotel’s guest room from 3:00 p.m. to 11:00 a.m. the following day. However, when staying for consecutive nights, guests may stay in the room for the entire day excluding the days the guest arrives at and leaves the Hotel.
  • 2. Notwithstanding the provisions of the previous paragraph, the Hotel may allow guest rooms to be used beyond the times stipulated in the said paragraph. The following additional charges will be required in this case.
    • (1) 30% of the room charge until 1:00 p.m.
    • (2) 60% of the room charge until 2:00 p.m.
    • (3) 90% of the room charge until 3:00 p.m.

Strict Observance of Regulations for Use
Article 10

  • 1. While inside the Hotel, guests shall adhere to the regulations for use determined by the Hotel and displayed inside the Hotel.

Operating Hours
Article 11

  • 1. Operating hours of the main facilities, etc. of the Hotel are as indicated below. Information on the operating hours of other facilities, etc. can be found in the brochures provided, notices posted throughout the Hotel, and in the service directory in the guest room.
    • (1) Front Desk service: 24 hours
    • (2) crescita restaurant: Breakfast served from 7:30 a.m. to 10:00 a.m. and dinner served from 5:30 p.m. to 10:00 p.m.
    • (3) Communal bathing area (Main Wing B1): Open from 6:00 a.m. to 10:00 a.m. and from 3:00 p.m. to midnight
    • (4) Thermal pool (Main Wing B1): Open from 8:00 a.m. to 10:00 p.m.
    • (5) Gift shop (Main Wing 1F): Open from 8:00 a.m. to 9:00 p.m.
  • 2. The operating hours indicated in the previous paragraph may be subject to change without notice in the event of unavoidable circumstances. The Hotel will take the appropriate action for notifying guests in such instances.

Payment of Charge
Article 12

  • 1. Payment of the accommodation charge, etc. described in previous paragraphs shall be paid at the Front Desk when arriving at the Hotel or when requested by the Hotel, and payment shall be in cash or by a method accepted by the Hotel, such as a credit card.
  • 2. After the Hotel has provided a guest room to the guest and the room can be used, the accommodation charge shall be charged even if the guest voluntarily does not stay in the Hotel.

Responsibilities of the Hotel
Article 13

  • 1. In the event that the Hotel inflicts damages on guests in the performance or non-performance of the accommodation agreement and its related agreements, the Hotel shall compensate those damages. However, this shall not apply if this is not attributable to the Hotel.
  • 2. While the Hotel has received a Fire Safety Certification Mark from the fire department, it is also covered by hotel accommodation liability insurance in case of fire, and other incidents.

When Contracted Guest Rooms Cannot Be Provided
Article 14

  • 1. When the Hotel cannot provide a contracted guest room to a guest, the Hotel shall, with the agreement of the guest, attempt to arrange a stay at another accommodation facility under conditions as similar as possible.
  • 2. Notwithstanding the provisions of the previous paragraph, if a different accommodation facility cannot be arranged, the Hotel shall reimburse the guest by paying a compensation fee equivalent to the penalty charge, and that compensation fee shall be allocated to the compensation for damages. However, the compensation fee shall not be paid if a guest room cannot be provided for reasons not attributable to the Hotel.

Handling Deposited Articles, etc.
Article 15

  • 1. In the event of loss or damage to items, cash, or valuables deposited by guests at the Front Desk, the Hotel shall compensate the guests unless the loss or damage is attributable to a force majeure.
  • 2. In the event that items, cash, or valuables brought into the Hotel by guests, which are not deposited at the Front Desk, are lost or damaged due to the malicious intent or gross negligence of the Hotel, the Hotel shall reimburse those damages. However, if the guest does not declare in advance the type or value of the deposited item, the damages reimbursed by the Hotel shall be limited to ¥150,000.

Storage of Guests’ Baggage and Belongings
Article 16

  • 1. If a guest’s baggage arrives at the Hotel before their stay, the Hotel shall be responsible for storing the baggage provided that the Hotel has agreed in advance, and the Hotel shall hand over the baggage to the guest when they check in at the Front Desk.
  • 2. If a guest accidentally leaves their baggage or belongings in the Hotel after checking out, the Hotel, after verifying the owner, shall contact the said owner and seek further instruction. However, if there are no instructions from the owner or the owner cannot be verified, the baggage or belongings shall be stored for seven days including the day of discovery, after which any valuable items shall be delivered to the nearest police station. Other items will be disposed of. Any food or beverage that has been opened will be disposed of immediately.
  • 3. The responsibility of the Hotel to store guests’ baggage and belongings stated in paragraph 2 above shall conform to the provisions in paragraph 1 of the previous article in the case of paragraph 1, and the provisions in paragraph 2 of the same article in the case of the preceding paragraph.

Parking Responsibility
Article 17

  • 1. When a guest uses a car park of the Hotel, regardless of whether or not the guest has deposited the keys to the vehicle, the Hotel is deemed as having rented the space and does not assume responsibility for the vehicle. However, in the event that damage is caused due to malicious intent or negligence of the Hotel in managing the car park, the Hotel shall be held responsible for compensation.

Responsibilities of the Guest
Article 18

  • 1. If the Hotel incurs damages due to the malicious intent or negligence of the guest, the said guest shall compensate the Hotel.
